1. About These Terms
These Terms and Conditions ("Terms") apply to your use of the Thread & Tread online shop at https://www.hindustanfactory.com/shop/koustav-dasgupta-qeab (the "Shop") and to every purchase you make from it. The Shop is operated by a group of young enthusiasts. By browsing the Shop or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Shop.
The Shop is hosted on a third-party marketplace platform, and your use of the platform is also subject to its own terms and policies.
2. Eligibility
You must be at least 18 years old, or be using the Shop under the supervision of a parent or guardian, to place an order. By ordering, you confirm that the information you give us is accurate and complete.
3. Products and Descriptions
We sell ethnic wear and footwear. We try to describe and photograph every product as accurately as we can, but please note:
- Colours may look slightly different on your screen than in person, depending on your device and lighting.
- Handcrafted and handloom items, embroidery, and prints may have small natural variations. These are part of their character and are not defects.
- Sizes can vary between styles and makers. Please check the size guide and measurements on each listing before ordering.
- Products are sold while stock lasts, and we may remove or change a listing at any time.
4. Pricing and Payment
All prices are shown in Indian Rupees (INR) and, unless stated otherwise, include applicable taxes. Shipping charges, if any, are shown at checkout before you pay.
We may change prices at any time, but the price you see when you place your order is the price you pay. If a price is listed incorrectly, we may cancel the order and refund you in full.
Payments are processed securely by the marketplace platform and its payment partners. We do not store your full card or banking details.
5. Orders and Acceptance
Placing an order is an offer to buy. We accept it when we confirm it by email, message, or through the platform. We may decline or cancel an order for reasons such as the item being out of stock, an error in the listing, an address we cannot deliver to, or suspected fraud. If we cancel an order you have already paid for, we will refund you in full.
6. Shipping and Delivery
- We ship to the addresses and areas supported by the platform and our courier partners.
- Orders are usually dispatched within [2] business days. Delivery usually takes [4 to 5] business days after dispatch, depending on your location.
- Delivery times are estimates, not guarantees. Delays caused by couriers, weather, festivals, or other events outside our control are not our liability.
- Please make sure your address and phone number are correct. We are not responsible for failed deliveries caused by incorrect or incomplete details.
- Risk of loss passes to you once the order is delivered to the address you gave.
7. Returns, Exchanges, and Refunds
- Return window: You may request a return or exchange within [7] days of receiving your order.
- Condition: Items must be unused, unwashed, unworn (footwear may be tried on indoors only), and in original packaging with all tags attached.
- Damaged or wrong items: If your item arrives damaged, defective, or different from what you ordered, contact us within 48 hours of delivery with photos, and we will arrange a replacement or refund.
- How to request: Email us at koustavdasgupta0@gmail.com with your order number and reason.
- Return shipping: We will bear the return shipping cost, except where the item is damaged, defective, or incorrect.
- Refunds: Approved refunds are issued to the original payment method within [7 to 10] business days after we receive and inspect the returned item. Your bank may take additional time to show the credit.
8. Cancellations
You may cancel an order before it is dispatched by contacting us at koustavdasgupta0@gmail.com. Once an order has been dispatched, it can only be returned under the terms in Section 7.
9. Intellectual Property
All content on the Shop, including the Thread & Tread name, logo, text, graphics, and product images we create, belongs to us or is used with permission, and is protected by intellectual property laws. You may not copy, reproduce, or use it for commercial purposes without our written permission. Brand names and trademarks of the makers of products we resell belong to their respective owners.
10. Acceptable Use
When using the Shop, you agree not to:
- Provide false or misleading information
- Use the Shop for any unlawful or fraudulent purpose
- Attempt to disrupt, hack, or gain unauthorised access to the Shop or the platform
- Copy or scrape our content or product images
- Post abusive, defamatory, or harmful messages or reviews
We may refuse service or cancel orders if we reasonably believe these Terms have been broken.
11. Disclaimer of Warranties
The Shop and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we do not make any promises that the Shop will be uninterrupted or error-free. Nothing in these Terms limits any rights you have under applicable consumer protection laws.
12. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from your use of the Shop or the products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. This does not exclude liability that cannot be excluded by law.
13. Privacy
Your personal information is handled as described in our Privacy Policy. By using the Shop, you consent to that handling.
14. Changes to These Terms
We may update these Terms from time to time. The latest version will be posted on the Shop with the "Last updated" date above. Orders are governed by the Terms in force when you placed them.
15. Governing Law and Disputes
These Terms are governed by the laws of INDIA. Any dispute that cannot be resolved by discussion will be subject to the exclusive jurisdiction of the courts at KOLKATA / WEST BENGAL. Nothing here affects your statutory rights as a consumer.
