Welcome to BazarBee.

These Terms & Conditions (“Terms”) govern your access to and use of the BazarBee website, mobile application, platform, products, and related services (collectively, the “Services”).

By accessing, browsing, registering on, or using BazarBee, you agree to be bound by these Terms, our Privacy Policy, and any other policies or guidelines made available through our Services.

If you do not agree with these Terms, please do not use BazarBee.

1. About BazarBee

BazarBee (“BazarBee”, “we”, “us”, or “our”) operates an online platform that may allow users to discover, purchase, sell, or otherwise access products and services offered through the platform.

Depending on the transaction, products may be sold directly by BazarBee or by independent third-party sellers, suppliers, or merchants (“Sellers”).

Where applicable, the identity of the Seller will be displayed on the relevant product or order page.

2. Eligibility

To use BazarBee, you must:

Be legally capable of entering into a binding contract under applicable law;
Provide accurate and complete information when required;
Comply with these Terms and all applicable laws and regulations.

If you are using BazarBee on behalf of a company, organization, or another legal entity, you represent that you have authority to bind that entity to these Terms.

3. Account Registration

Certain features may require you to create an account.

You agree to:

Provide accurate, current, and complete information;
Keep your account information updated;
Maintain the confidentiality of your password, OTP, and other account credentials;
Notify us promptly of unauthorized access to your account;
Accept responsibility for activities carried out through your account, except where caused by our failure to maintain reasonable security.

You must not create an account using another person's identity or provide false information.

BazarBee reserves the right to suspend or terminate accounts that contain inaccurate information or are used in violation of these Terms.

4. Products and Product Information

We make reasonable efforts to ensure that product descriptions, images, specifications, prices, availability, and other information displayed on BazarBee are accurate.

However:

Product colors may appear differently depending on your device or display.
Images may be for illustrative purposes where expressly indicated.
Product specifications may change.
Availability may change without notice.
Minor variations in packaging, appearance, or labeling may occur.

We do not guarantee that every product description or other information will always be completely accurate, current, or error-free.

If a product is materially different from its description, your rights will be governed by our applicable return, refund, and consumer-protection policies.

5. Prices and Taxes

All prices displayed on BazarBee are subject to change without prior notice.

Unless otherwise stated, applicable taxes, shipping charges, platform fees, convenience fees, or other charges may be displayed separately or included in the displayed price.

We make reasonable efforts to ensure that prices are accurate. If a pricing or listing error occurs, we reserve the right to:

Correct the price;
Cancel the affected order; or
Contact you for instructions before processing the order.

If an order is cancelled because of an obvious pricing or listing error, any amount paid for that order will be refunded in accordance with our refund process.

6. Placing an Order

When you place an order, you are making an offer to purchase the selected product(s) subject to these Terms.

After placing an order, you may receive an order confirmation. An order confirmation does not necessarily mean that the order has been finally accepted.

We reserve the right to accept, reject, limit, or cancel an order for legitimate reasons, including:

Suspected fraud or unauthorized activity;
Delivery restrictions;
Payment failure;
Violation of these Terms; or

By submitting payment information, you represent that you are authorized to use the selected payment method.

BazarBee may accept payment methods including, where available:

Credit and debit cards;
UPI;
Net banking;
Wallets;
Cash on delivery; and
Other payment methods displayed on the platform.

Payment processing may be subject to the terms and privacy policies of the relevant payment provider.

BazarBee does not guarantee the uninterrupted availability of any particular payment method.

8. Delivery

We will make reasonable efforts to deliver products within the estimated delivery period displayed at the time of purchase.

Delivery dates and estimates are not guaranteed unless expressly stated otherwise.

Delivery may be affected by factors outside our reasonable control, including:

Weather;
Natural disasters;
Transportation disruptions;
Strikes;
Government restrictions;
Incorrect or incomplete addresses;
Customer unavailability; or
Other unforeseen circumstances.

You are responsible for providing a complete and accurate delivery address and contact information.

Additional delivery charges may apply in certain locations or circumstances.

9. Returns, Refunds, and Cancellations

Returns, refunds, replacements, and order cancellations are governed by BazarBee's applicable Return & Refund Policy.

Different products may have different eligibility requirements depending on their nature, condition, Seller, manufacturer warranty, and applicable law.

You may be required to:

Request a return within the specified period;
Provide photographs or other evidence;
Keep the original packaging and accessories;
Return the product in the required condition; and
Follow the instructions provided by BazarBee or the Seller.

Nothing in these Terms limits any mandatory consumer rights available to you under applicable law.

10. Seller Terms

Where BazarBee operates as a marketplace, Sellers are responsible for their products and for complying with applicable laws and platform requirements.

Sellers are responsible for ensuring that:

Products are accurately described;
Products are legally permitted to be sold;
Products meet applicable quality and safety requirements;
Required licenses, registrations, and approvals are maintained;
Prices and product information are accurate; and
Orders are fulfilled according to applicable requirements.

BazarBee may take action against Sellers who violate applicable laws, policies, or these Terms.

11. Prohibited Activities

You agree not to use BazarBee to:

Violate any applicable law or regulation;
Commit fraud or facilitate fraudulent transactions;
Use another person's account without authorization;
Provide false, misleading, or deceptive information;
Interfere with the operation or security of BazarBee;
Attempt to gain unauthorized access to our systems;
Introduce malware, viruses, or other harmful code;
Scrape, crawl, copy, or systematically extract platform data without authorization;
Reverse engineer or attempt to circumvent platform security;
Use automated systems in a manner that places unreasonable load on our Services;
Post unlawful, defamatory, abusive, obscene, or infringing content;
Manipulate ratings, reviews, orders, promotions, or other platform features;
Use BazarBee for unauthorized commercial purposes; or
Resell or exploit our Services without our written permission.

We may suspend or terminate access where we reasonably believe that prohibited activity has occurred.

12. User Content and Reviews

BazarBee may allow users to submit reviews, ratings, photographs, comments, questions, or other content (“User Content”).

You remain responsible for the User Content you submit.

By submitting User Content, you represent that:

You have the necessary rights to submit it;
It is accurate to the best of your knowledge;
It does not violate another person's rights;
It does not contain unlawful, threatening, abusive, defamatory, or fraudulent material; and
It does not contain malicious software or harmful code.

You grant BazarBee a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, publish, and distribute your User Content as reasonably necessary to operate, promote, and improve our Services.

We reserve the right to remove User Content that violates these Terms or applicable law.

13. Intellectual Property

All intellectual property associated with BazarBee, including:

Brand names and logos;
Website and application design;
Text and graphics;
Product and platform content;
Software and code;
Trademarks;
Images and videos; and
Other materials,

is owned by or licensed to BazarBee or the relevant rights holder and is protected by applicable intellectual-property laws.

You may use the Services only for their intended purpose.

You may not copy, modify, distribute, reproduce, publish, sell, license, or commercially exploit BazarBee's intellectual property without prior written authorization.

14. Third-Party Services

BazarBee may integrate with or link to third-party services, including payment processors, logistics providers, analytics services, social-media platforms, and other external services.

Third-party services are governed by their own terms and policies.

BazarBee is not responsible for the availability, content, security, or practices of third-party services except to the extent required by applicable law.

15. Promotions and Offers

From time to time, BazarBee may offer discounts, coupons, promotional codes, cashback, contests, or other promotional programs.

Each promotion may have additional terms and conditions.

Unless otherwise stated:

Promotions cannot be exchanged for cash;
Promotional benefits may not be combined;
Promotions may be subject to eligibility requirements;
Promotional codes may have expiration dates; and
BazarBee may withdraw or modify promotions where permitted by law.

Any attempt to abuse or manipulate promotional programs may result in cancellation of the relevant benefit or order.

16. Privacy

Your use of BazarBee is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal information.

By using BazarBee, you acknowledge that you have reviewed our Privacy Policy.

17. Availability of the Services

We aim to keep BazarBee available and functioning properly, but we do not guarantee that the Services will always be:

Available;
Uninterrupted;
Secure;
Error-free; or
Free from viruses or other harmful components.

We may temporarily suspend or restrict access for maintenance, upgrades, security reasons, operational requirements, or other legitimate purposes.

18. Disclaimer

To the maximum extent permitted by applicable law, BazarBee does not guarantee that:

All information on the platform is completely accurate or error-free;
Products will always be available;
Orders will always be accepted;
Delivery will occur within a particular timeframe; or
The Services will always operate without interruption.

Nothing in these Terms excludes or limits rights or protections that cannot legally be excluded or limited.

19. Limitation of Liability

To the maximum extent permitted by applicable law, BazarBee and its directors, officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Our liability, where legally permitted to be limited, will be limited to the amount you paid to BazarBee for the transaction giving rise to the claim or such other limitation required by applicable law.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless BazarBee, its affiliates, directors, officers, employees, agents, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

Your violation of these Terms;
Your misuse of the Services;
Your violation of applicable law;
Your infringement of another person's rights; or
Your User Content.

This provision will apply only to the extent permitted by applicable law.

21. Suspension and Termination

BazarBee may suspend or terminate your account or access to the Services where permitted by law if:

You violate these Terms;
You engage in fraudulent or abusive activity;
Your account poses a security risk;
You provide false or misleading information;
Your activity may cause harm to BazarBee or other users; or
We are legally required to do so.

You may stop using the Services at any time.

Termination does not affect rights or obligations that accrued before termination.

22. Changes to These Terms

We may update these Terms from time to time.

Updated Terms will be posted on the BazarBee website or application and will become effective from the date specified in the updated Terms.

Your continued use of BazarBee after the effective date of updated Terms constitutes acceptance of the revised Terms, to the extent permitted by law.

23. Governing Law

These Terms shall be governed by the laws of India, without regard to conflict-of-law principles.

Subject to any mandatory rights available to consumers under applicable law, disputes arising from or relating to these Terms or the Services shall be subject to the jurisdiction of the courts at [City, State, India].

24. Dispute Resolution and Consumer Rights

We encourage users to contact BazarBee first so that we can attempt to resolve complaints or disputes efficiently.

Nothing in these Terms is intended to restrict any statutory consumer rights, remedies, or dispute-resolution mechanisms available to you under applicable Indian law.

Where applicable, users may also have rights under India's consumer-protection and e-commerce laws.

25. Force Majeure

BazarBee will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, epidemics, war, terrorism, civil disturbances, strikes, governmental actions, internet or telecommunications failures, transportation disruptions, or other similar events.

26. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified or removed to the minimum extent necessary, while the remaining provisions will continue to remain in effect.

27. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, and any other policies expressly incorporated into these Terms, constitute the agreement between you and BazarBee regarding your use of the Services.
